Mark E. Adamczyk has been a Naples resident since 1990 and is a founding shareholder of Goede & Adamczyk, PLLC. Mark focuses a substantial portion of his practice on community associations, real estate transactions and real estate litigation. He also has significant experience in estate planning, probate and corporate matters.

Mark started his real estate law practice in the commercial real estate division of a large Atlanta, Georgia firm. Mark had the opportunity to represent developers, national restaurant chains, institutional lenders and wireless telecommunications companies in the acquisition and leasing of commercial real estate. In that capacity, Mark gained extensive training in title examination, title insurance, contract drafting and lease drafting which helped pave the way for his current real estate practice.

Today, Mark represents buyers and sellers on approximately 30 residential transactions per month and continues to assist landlords, tenants and investors in commercial leases and development. Through his real estate and community association practice in Florida, Mark has also had the opportunity to handle complex real estate and title litigation involving breach of contract, quiet title, easement and access disputes and evictions. Mark has also had recent significant experience representing landowners in land use disputes involving local government authorities.

For community associations (condo & HOA’s), Mark advises condo and HOA boards on a daily basis in all legal matters affecting their community. Mark has been an industry leader in the areas of collections (of delinquent assessments, fines and rents), liens and foreclosures. Mark was one of the first attorneys in his region to obtain a receivership to collect rents in a community wrought with investor landlords who are not paying owner assessments. Mark has successfully negotiated amendments to long-term bulk cable television contracts, resulting in thousands in savings for communities. For each of his condo and HOA clients, Mark develops an aggressive custom collections strategy that fits the community’s needs and legal budget.

Mark also has extensive experience in drafting community documents and amendments, covenant enforcement, fair housing disputes (service and emotional support animals) and disputes involving elections and directors.

Mark’s full service real estate and community practice has also given him the opportunity to create estate plans for clients and investors. Mark has prepared wills, trusts and estate plans for large and small estates and has handled a wide variety of probates and trust administrations.

Mark also handles the formation of corporations, LLC’s and land trusts and has the necessary experience to advise investors and other clients on protection of assets. Mark also handles business closings involving professional practices, retail and other businesses
